1. Who we are and acceptance of these Terms

Welcome to safekeepglobal.com (the "Site"). The Site is owned and operated by Safekeep Global, of 1309 Coffeen Ave STE 18895, Sheridan, Wyoming 82801, United States ("we", "us" or "our").

By accessing or using the Site, you agree to these Terms of Use ("Terms") and to our Privacy Policy, which is incorporated into these Terms. If you do not agree, do not use the Site.

The Site is intended for users who are at least 18 years old and have the legal capacity to enter into a binding contract. By using the Site, you confirm that you meet these requirements.

2. Nature of the Site

The Site is an informational platform and enquiry portal for the services of Safekeep Global, an asset protection advisory, corporate structuring and bookkeeping firm that coordinates between clients and licensed professionals in each relevant jurisdiction.

No contract for paid services is formed by browsing the Site, submitting an enquiry, downloading content, or booking or attending a call. Paid engagements are governed by a separate Master Services Agreement and Letter of Engagement executed between Safekeep Global and the client.

Nothing on the Site guarantees any tax, financial, legal or commercial outcome, including any saving, return or protection from any authority, creditor or claim.

3. No professional, personal or licensed advice

All content on the Site, and anything we say in calls, emails, videos, guides, case studies or consultations arranged through the Site, is general information only. It is not, and must not be relied on as, tax, legal, accounting, investment or personal financial advice.

We are not a registered tax agent, certified public accountant, chartered accountant or law firm, and we are not licensed to provide personal financial product advice or to file tax returns in any jurisdiction. Regulated work is carried out by licensed professionals we coordinate with.

Nothing on the Site takes account of your objectives, financial situation or needs. It is not a personal recommendation, and no strategy is one-size-fits-all: what works for one person, entity or jurisdiction may be wrong for another.

Any decision to adopt, or not adopt, any strategy, structure or idea described on the Site is yours alone. Before acting, you must obtain advice from an appropriately qualified and licensed professional (for example a licensed financial adviser, registered tax agent, accountant or lawyer) in each jurisdiction that applies to you.

Tax, corporate and asset-protection law is a moving and evolving territory. Laws, treaties, rulings and administrative practice change frequently and sometimes retrospectively. Content that was accurate when published may become outdated or wrong, and any strategy may need to change or become unsuitable. We are under no obligation to update Site content.

Your use of the Site, and any enquiry, call or consultation arranged through it, does not create any fiduciary, adviser-client or other professional relationship between you and Safekeep Global. Site content may contain errors or omissions, and you are responsible for verifying the current law before acting.

You acknowledge and accept this clause 3.

4. Intellectual property

The "Safekeep Global" name and branding, and all content on or available through the Site, including text, graphics, logos, guides, diagrams, case studies, videos, frameworks, methodologies, software, workflows and know-how, are owned by Safekeep Global or its licensors.

You may view, download and print Site content for your personal, non-commercial use only. You may not copy, scrape, reproduce, modify, distribute, publish, transmit, reverse-engineer, train artificial intelligence models on, or commercially exploit any part of the Site or its content without our prior written consent.

If you send us feedback, suggestions or ideas about the Site or our services, we may use them for any business purpose, without restriction or compensation, except as prohibited by law. This does not apply to your personal information, which is handled under our Privacy Policy.

5. Calls, recordings and monitoring

Phone calls and video calls with us, including discovery calls, consultations and support calls booked or initiated through the Site, may be recorded, monitored, transcribed and analysed, including by artificial intelligence tools, for quality assurance, training, verification, service delivery, compliance and dispute-resolution purposes.

You will be notified at or before the start of a recorded call. By continuing with a call after a recording disclosure, you consent to the recording and monitoring described in this clause and in our Privacy Policy. If you do not consent, tell us at the start of the call or end the call.

6. Data, AI processing and cross-border transfer

When you submit an enquiry, book a call or otherwise provide information through the Site, you acknowledge that:

  • your information (including lead and contact data) is processed through our software, technology and artificial intelligence tools, which assist us to assess enquiries, prepare responses and deliver our services;
  • our operations are cross-border: your information may be transferred to, stored in and processed in countries other than your country of residence, including the United States and the countries where our staff, service providers and licensed partners operate; and
  • we take reasonable steps to protect your information, as described in our Privacy Policy.

By using the Site or submitting information, you consent to this processing. If you do not consent, do not submit personal information through the Site.

7. User conduct

You agree not to:

  • use any bot, spider, scraper or automated tool to access or extract data or content from the Site;
  • attempt to bypass security features, access restricted areas or interfere with the Site's operation;
  • use the Site or our contact channels to send spam, viruses or unlawful, false or infringing content; or
  • use the Site in breach of any law that applies to you.

We may suspend or block your access to the Site for breach of these Terms, without notice.

Nothing in these Terms prevents you from leaving truthful, good-faith reviews of our services on any platform.

8. Third-party links

The Site may link to or integrate with third-party websites and platforms. We do not control them and are not responsible for their content, availability or data practices. Your use of third-party services is at your own risk and subject to their terms.

9. Disclaimer and limitation of liability

THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

To the maximum extent permitted by law, Safekeep Global and its members, officers, employees, contractors and agents are not liable for any direct, indirect, incidental, consequential or special loss or damage (including loss of profits, savings, data or opportunities) arising from your use of, or reliance on, the Site or its content.

To the maximum extent permitted by law, our total aggregate liability to you arising out of or in connection with the Site or these Terms shall not exceed USD $100. This cap does not apply to liability for fraud, gross negligence or wilful misconduct, or to any liability that cannot lawfully be limited.

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under a law that applies to you and cannot lawfully be excluded.

10. Indemnification

You agree to indemnify and hold harmless Safekeep Global and its members, officers, employees, contractors and agents from any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from your use or misuse of the Site, your breach of these Terms, your infringement of any third-party rights, or any information you submit that is false, misleading or unlawful.

11. Changes to these Terms

We may update these Terms at any time by posting the updated version on the Site. Material changes will be indicated by updating the "Last updated" date. Your continued use of the Site after a change constitutes acceptance of the updated Terms.

Any material change to clause 12 (Governing Law and Dispute Resolution) applies prospectively only: it does not apply to any dispute that arose, or of which either party had notice, before the change was posted.

12. Governing law and dispute resolution

These Terms and any dispute arising out of them or the Site are governed by the laws of the State of Wyoming, United States, to the maximum extent permitted by the laws that apply to you, without prejudice to any non-waivable rights you have under the laws of your place of residence.

Before starting any proceedings, the parties will attempt in good faith to resolve any dispute by negotiation for 30 days from written notice of the dispute.

Any dispute not resolved by negotiation shall be finally resolved by binding arbitration administered by the American Arbitration Association under its rules, seated in Wyoming, United States, before a single arbitrator, conducted in English. Judgment on the award may be entered in any court with jurisdiction. Where the AAA's Consumer Arbitration Rules apply, they govern, and we will pay all filing, administration and arbitrator fees beyond the amount those rules require you to pay. Hearings may be conducted by videoconference or, where the rules allow, decided on the documents, so you are not required to travel to attend.

All disputes must be brought on an individual basis only. To the maximum extent permitted by law, you waive any right to bring or participate in a class, collective or representative action against us, and the arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular dispute, that dispute (and only that dispute) shall proceed in a court of competent jurisdiction, not in class or representative arbitration, and the rest of this clause remains in force.

This clause does not prevent either party from bringing an individual claim in a small-claims court with jurisdiction, or from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property rights, and does not limit any non-waivable right you have to bring claims in the courts of your place of residence. The arbitrator (and not a court) decides whether a dispute falls within this clause, except that a court decides the enforceability of the class-action waiver. This clause 12 survives termination of these Terms and of your use of the Site.

13. General

  • Survival: clauses 3 (no advice), 4 (intellectual property), 9 (liability), 10 (indemnification) and 12 (dispute resolution) survive termination of these Terms and of your access to the Site.
  • Severability: if any provision of these Terms is invalid or unenforceable, the rest remains in force.
  • Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us about the Site. They do not replace any Master Services Agreement or Letter of Engagement you sign with us.
  • Force majeure: we are not liable for delay or failure caused by events beyond our reasonable control.
  • No waiver: our failure to enforce a right is not a waiver of it.
  • Assignment: we may assign these Terms; you may not assign them without our written consent.
